Terms of Service

Welcome to Artful Escapes (“Company,” “we,” “our,” or “us”). By accessing our website artfulescapes.ca (the “Site”), purchasing tickets, registering for an event, or otherwise engaging with our services (the “Services”), you agree to be legally bound by these Terms of Service (the “Terms”).

Please read carefully before participating. If you do not agree, please do not use our Services.

1. Definitions

- “Events” means any art workshops, paint parties, retreats, or related activities hosted by Artful Escapes.

- “Participant” or “you” means any person who attends or registers for our Events or uses our Site.

-“Content” means all materials including artwork, text, designs, images, logos, videos, and other materials provided by Artful Escapes.

2. Eligibility & Registration

  • You must be at least 18 years old to register or purchase tickets. Minors under 18 may attend only under the supervision of a parent or legal guardian.

  • You agree to provide accurate, complete, and up-to-date information when registering. Artful Escapes reserves the right to refuse registration or entry for any reason.

3. Payments, Refunds & Cancellations

  • All ticket sales are final unless otherwise stated in writing. No refunds will be issued for participant cancellations, no-shows, or partial attendance.

  • In the event of illness, emergencies, or unforeseen circumstances, we may, at our sole discretion, offer a credit toward a future event.

  • If Artful Escapes cancels or reschedules an event, participants will be notified and given options for either a full refund or credit toward a future event.

  • Refunds (if granted) will be issued to the original payment method only.

4. Participant Responsibilities & Conduct

By attending an Event, you agree to:

  • Follow all instructions provided by event facilitators and venue staff.

  • Treat all participants, staff, and property with respect.

  • Avoid disruptive, inappropriate, unsafe, or unlawful behavior.

We reserve the right to remove any participant from an Event without refund if these expectations are not met.

5. Assumption of Risk & Release of Liability

By registering for or attending an Event, you acknowledge and agree that:

  • Participation involves inherent risks, including but not limited to: use of art materials, physical activity, outdoor environments, weather conditions, food or beverage consumption (if applicable), and interactions with others.

  • You voluntarily assume all risks of injury, illness, allergic reaction, property damage, or loss that may occur during or as a result of participation.

  • Artful Escapes, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, injuries, illnesses, or losses related to your participation.

  • You release and forever discharge Artful Escapes from all claims, demands, or causes of action arising from your participation, except where prohibited by law.

  • Participants are responsible for their own transportation to and from Events. Artful Escapes is not liable for travel delays, accidents, or expenses incurred.

6. Event Supplies & Property

  • Artful Escapes provides professional art supplies for Events unless otherwise specified. You are responsible for proper use and care of supplies.

  • You may be charged for damage caused by reckless or intentional misuse of supplies, equipment, or property.

7. Intellectual Property Rights

  • All Event content, instructional materials, artwork designs, logos, photos, and videos created by Artful Escapes are protected by copyright and trademark law.

  • You may not copy, reproduce, record, or distribute our materials for commercial use without prior written consent.

  • Participants retain ownership of their personal artworks created at Events, but grant Artful Escapes permission to photograph, display, or share them for promotional purposes (unless you opt out in writing).

8. Media Release

By attending or participating in an Event hosted by Artful Escapes, you understand and agree that:

  • Photos, videos, and audio recordings may be taken during the Event by Artful Escapes staff, contracted photographers, or other participants.

  • These images and recordings may capture your likeness, voice, artwork, or participation in the Event.

  • You grant Artful Escapes a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, distribute, display, and publish these images and recordings in any medium (including websites, social media, advertising, and printed materials) for promotional or educational purposes.

  • You waive any rights to inspect or approve the use of such media or to receive compensation.

  • If you do not wish to be photographed or recorded, you must provide written notice before the Event and inform our staff on-site. We will make reasonable efforts to accommodate your request, but we cannot guarantee exclusion from group or background shots.

Media Use at Partner Venues

  • By hosting an Artful Escapes Event, Partner Venues acknowledge and agree that photographs, videos, and other media may be captured during the Event.

  • Artful Escapes retains full rights to use such media, including images of the venue, its facilities, and surroundings, for promotional, educational, and commercial purposes in any format (including social media, websites, printed materials, and advertising).

  • While Artful Escapes may choose to tag or mention the Partner Venue at its discretion, there is no obligation to provide credit or tags in every use of the media.

  • The Partner Venue waives any rights to inspect, approve, or restrict the use of such media and agrees not to make claims of ownership or compensation related to the media created during Events.

9. Website Use

  • You agree to use the Site lawfully and not to interfere with its operation or security.

  • Artful Escapes may suspend or terminate access to the Site if misuse is detected.

  • We do not guarantee uninterrupted or error-free access to the Site.

10. Disclaimers

To the maximum extent permitted by law:

  • No Guarantees of Outcomes: Artful Escapes provides creative experiences for enjoyment and education. We do not guarantee that you will achieve any particular artistic result, level of skill, or satisfaction. Artistic outcomes are highly subjective.

  • Event Changes: Events may be altered due to weather, illness of instructors, venue availability, or other unforeseen circumstances. In such cases, we will make reasonable efforts to notify participants promptly and provide alternatives (such as rescheduling, relocation, or online options).

  • Supplies and Materials: While we provide quality supplies, we do not warrant that they will be free of defects or that they are hypoallergenic or suitable for every participant. Participants are responsible for notifying us of allergies or sensitivities prior to the Event.

  • Service Availability: We do not warrant uninterrupted or error-free access to our Site or Services. Technical issues may occur due to maintenance, third-party providers, or circumstances beyond our control.

  • Limitation of Liability: Under no circumstances shall Artful Escapes be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of enjoyment, loss of data, or emotional distress, arising out of participation in our Events or use of our Services.

11. Privacy & Communications

  • By registering, you consent to receive transactional emails related to your booking. You may also opt-in to newsletters or promotional emails.

  • We respect your privacy and handle personal information in accordance with our [Privacy Policy].

12. Third-Party Services & Links

Our Site may include links to third-party websites or services. Artful Escapes is not responsible for the content, security, or practices of third-party providers.

13. Indemnification

You agree to defend, indemnify, and hold harmless Artful Escapes, its owners, employees, contractors, partners, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your participation in or attendance at any Event;

  • Any personal injury, illness, damage, or loss you cause to yourself, other participants, or property;

  • Your violation of these Terms or any applicable law;

  • Your infringement of third-party rights, including intellectual property, privacy, or publicity rights;

  • Any disputes between you and another participant or third party at or outside the Event connected to Artful Escapes.

This indemnity survives your use of the Services and participation in any Event.

14. Governing Law & Dispute Resolution

    • These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

    • Jurisdiction: You agree to submit to the exclusive jurisdiction of the provincial and federal courts located in Ontario for the resolution of disputes.

    • Dispute Resolution: Before pursuing legal remedies, both parties agree to make good faith efforts to resolve disputes through informal negotiation. If negotiation fails, the parties may agree to mediation or arbitration before resorting to litigation.

    • Limitation Period: Any claim you may have against Artful Escapes must be filed within one (1) year after the cause of action arises; otherwise, the claim is permanently barred.

15. Changes to Terms

  • Artful Escapes reserves the right to update, modify, or replace these Terms at any time without prior notice.

  • The most current version will always be posted on artfulescapes.ca with the “Effective Date” updated at the top of the document.

  • It is your responsibility to review these Terms periodically to stay informed.

  • Continued use of our Site, Services, or attendance at Events after changes are posted constitutes your acceptance of the updated Terms.

  • If you do not agree with the revised Terms, your sole remedy is to discontinue using our Services and refrain from attending future Events.

17. Partner Venues (Farms, Restaurants, Wineries, and Other Hosts)

  • Many of our Events are hosted at third-party venues such as farms, wineries, restaurants, studios, or other event spaces (“Partner Venues”).

  • While Artful Escapes provides the creative art experience, the Partner Venue is responsible for its own facilities, staff, services, and policies.

  • By registering for an Event, you acknowledge and agree that:

    • Artful Escapes is not responsible for the condition, safety, or accessibility of the Partner Venue.

    • Any food, drinks, or other services provided by the Partner Venue are the sole responsibility of the venue. We do not monitor or control these services.

    • If alcohol is served, you agree to comply with all applicable laws, venue policies, and age restrictions. Artful Escapes is not liable for any issues arising from alcohol consumption or service.

    • Farms and outdoor venues may involve exposure to animals, insects, uneven ground, weather conditions, or other natural elements. You assume all risks associated with attending an Event at such locations.

    • Parking, transportation, and accessibility are provided by the Partner Venue (unless otherwise stated) and are not the responsibility of Artful Escapes.

  • Any disputes, complaints, or claims relating to Partner Venue facilities, food, beverages, or non-Artful Escapes services must be directed to the Partner Venue.
